Terms of Service for Speed AI

Welcome to Speed AI! These Terms of Service ("Terms") govern your use of the Speed AI mobile application (the "App") and website (collectively, the "Services"), provided by Speed AI, Inc. ("we," "us," or "our"), a Delaware corporation based in New York. By downloading, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Use of the App

The Speed AI App is designed to track your runs, provide personalized training plans, and help you achieve your fitness goals. You may use our Services for personal, non-commercial purposes only. You must be at least 13 years old to use our Services.

2. Account Creation

To access certain features, such as personalized training plans, you need to create an account using your email address and name. You’re responsible for providing accurate information and keeping your account secure (e.g., don’t share your password). Let us know immediately at [email protected] if you suspect unauthorized use of your account.

3. Subscription and Payments

Free Trial and Premium Subscription

  • We offer a 2-week free trial of our premium features, including advanced training plans.
  • After the trial, you can subscribe to our premium plan via the Apple App Store.
  • Subscriptions renew automatically unless canceled before the renewal date.

Pricing and Payments

  • Pricing is as displayed on our website or in the App at the time of purchase.
  • Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
  • For App Store purchases, payments are processed through the Apple App Store.
  • We are never in possession of your card details for transactions processed through Paddle for PCI DSS Compliance reasons.
  • Before completing your purchase, you will be clearly shown what products you're paying for and the amount you're committing to (including whether you're entering into a subscription).

Refund Policy

  • We offer a 30-day money back guarantee for all purchases made through our website.
  • If you're not satisfied with our Services, you may request a full refund within 30 days of purchase by contacting us at [email protected].
  • For App Store purchases, refunds are subject to Apple's policies and our discretion.

Cancellation

  • You can cancel your website subscription anytime by contacting [email protected].
  • For App Store subscriptions, you can cancel through your Apple App Store account settings.
  • Cancellation takes effect at the end of your current billing cycle.

4. Medical Disclaimer

Not Medical Advice

The Services provide workout tracking and training plans for informational and educational purposes only. They are not a substitute for medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any exercise program or making health-related decisions.

Use at Your Own Risk

You use our Services and follow its training plans at your own risk. We are not responsible for any injuries, health issues, or other adverse outcomes that may result from your use of our Services or reliance on its recommendations.

5. Data and Privacy

We collect information like your email, name, location, and fitness stats (e.g., workout history, running data) to provide and improve our Services. For full details, including how we use HealthKit data (if you enable it), see our Privacy Policy. Your use of our Services means you agree to our data practices as outlined there.

6. Third-Party Services

We use PostHog for analytics to improve our Services' performance. We don't share your data with advertising partners. If you connect third-party services like Garmin, their terms and privacy policies apply to the data you share with them.

7. Intellectual Property

Our Services, including their design, code, and content (like training plans), are owned by Speed AI, Inc. or our licensors. You may not copy, modify, distribute, or reverse-engineer them without our written permission.

8. Disclaimers

  • Our Services are provided "as is" without warranties of any kind. We don't guarantee that they will be error-free, uninterrupted, or perfectly accurate (e.g., distance tracking might vary based on your device).
  • We're not liable for any damages, including injuries or losses, arising from your use of our Services, to the fullest extent allowed by law.

9. Termination

We may suspend or terminate your access to our Services at our discretion, including if:

  • You fail to pay for your subscription.
  • You violate these Terms (e.g., misuse our Services or attempt to hack it). If we terminate your access, you'll lose access to premium features, but you can still request a refund if eligible.

10. Changes to the Terms

We may update these Terms from time to time. We'll notify you via email or in the App at least 30 days before major changes take effect. Continued use of our Services after changes means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in New York County, New York.

12. Complaint Policy
